Gannon Stauch - The Affidavit

ABOUT THIS EPISODE

Hi Guys, and welcome back to did you lock the door? The podcast. I'm your host, Peyton Reese, and today I'm bringing you yet another very important update on the Gannon stout case. I've been following this one pretty much from the beginning. It's one that I think is particularly upsetting and particularly important to get covered out there and get his name out there and let his family know that the whole world cares about this little boy. I was hoping to bring this update to you a little bit sooner. School work has really been ripping me a new one lately, but I'm doing it now and I'm so excited to get into this super important information for you guys. So, without further ADO, we're going to go over the affidavit that was recently released in the case. It shares a lot of information with us. I mean, I'm sure all of us know that the police often know a lot more than they're sharing with the public, but wow, the police knew a lot and has been fascinating to read through this thirty two page document. I've highlighted the most important parts that I think are most crucial to the case. So let's get into it. This affidavid was prepared by FBI Special Agent Cohen, and it outlines crimes committed against the victim, Gannon, by his stepmother, who is believed to be the perpetrator of these crimes, latitia. So just a reminder, the charges filed against Letitia in this case were murder in the first degree of a child under twelve, child abuse resulting in death, tampering with a deceased human body and tampering with physical evidence. And actually, guys, I should have mentioned this second ago. But before I get further into the affidavid, I do just want to warn any listeners that this is going to talk in some detail about a violent crime committed against a child. I know that's sensitive for some listeners, so please be warned. And it will also discuss sexual assault. It's a sexual assault claim made by Latitia that investigators do not believe actually happened, but I do just want to warn you there will be talk of sexual assault in regards to this case. So so if either of those things are particularly triggering for you, this might be an episode that you want to skip over. So, anyway, back to the AFFIDAVID.

It states that there were, quote, voluminous amounts of evidence collected, including physical evidence, video surveillance, cell phone data and statements made by the parties involved. Much of the affidavid describescannon as missing, although it was being treated as a murder investigation. As we know, Gannon's body was found on March twenty four of two thousand and twenty earlier this year. However, the affidavid was written before his body was found. So, like I just said, well, they are treating it as a murder investigation, he will be largely described as missing. So again, if you all remember, latitia initially reported Gannon missing at six hundred and fifty five pm on January twenty seven, stating that he had gone to play with a friend and had not come home yet, despite being told to come home before dark. Investigators do not think that Latitia went around to any friends houses to attempt to locate Gannon and she could not provide the names of any friends he might have gone to play with. A tip line was almost immediately established and two false claims came in pretty quickly by people claiming that they had gannon and demanding ransom. One of these ransom notes was linked back to a foreign email account believed to be used by multiple people and investigators were not actually able to trace this IP address. The second ransom note, I assume they were able to trace. However, it is not mentioned in the affidated. They do know now that both of these ransom demands were false. Neither of the people that sent them had Gannon. It's now really getting into the murder. Police believe that Gannon was killed by Latitia in his bedroom sometime after to fourteen pm on January twenty seven. They found physical evidence that supported this, and it included blood spatter on the walls enough to seep into the electrical socket near Gannon's bed and leave a ring around the socket when investigators removed it, blood stains on his mattress and blood that had seeped through the carpet on his floor, the carpet pad and down to the tile underneath. So we don't know exactly how Gannon was killed yet, but clearly it was so brutal. I am so, so sorry for this little boy. That makes me so sad to read. Blood was also found in the garage and in and around Latisha's Volkswagen Tiguan, I think that's how you say that. And these support the fact that, after committing this heinous crime, latitia loaded GANNON's body into the trunk of her car. Investigators also found carpet brushes in the Dishwasher, which appeared to have been recently run, along with an empty bottle of vinegar that Al, who was Gannon's father, would confirm had been half full prior to him going out of town, and it is believed that those carpet brushes were were used in clean up of the murder scene. It is believed that latitia initially dumped Gannon's body along a remote...

...area of highway one hundred and five South Perry Park Road in Douglas County, Colorado. As DNA matching Gannon was discovered in this area, behavior displayed by Latitia in the days and hours leading up to his murder support, in my opinion, premeditation on La Teacher's behalf. Just to be clear, this is not stated in the affidavid, but I think you all will agree with me. This seemed very planned and this behavior includes latitia telling Al, who again is Gannon's father, that Gannon was having stomach problems on the Sunday evening before he was killed and he would be killed the very next day. Monday the twenty seven, Latitia had Gannon stay home from school on Monday and called out of work herself. She actually told her boss that her stepfather had been struck by a car and killed and that was her excuse to get out of work that day. This woman has an incredible mind. Wow. Latitia took photos of Gannon at hundred and thirteen am and eight hundred and seventeen am the morning of the twenty seven that showed Gannon asleep in his bed. And just a side note, in one of these photos you can see Gannon's Nintendo switch lying next to him. We know that this switch meant a lot to Gannon. He loved playing video games, especially with his father, and this switch has yet to be found. I'll discuss that switch a little bit more later. Video surveillance captured by neighbor Roderick Drayton shows latitia and someone who we presumed to be Gannon getting into the Nissan frontier that the family owned, and this was primarily owl's car, at Sixteen am on the twenty seven. The vehicle returns at twenty two PM and although you cannot see Gannon exit the vehicle, and it was initially assumed that he did not return home with Latitia. Investigators were able to determine that he did in facts come back home with her. Investigators were able to confirm that Lena, who is Gannon's biological sister and owl's biological daughter, but letitia stepdaughter, was at school during this time. So gannon and Latitia were the only ones home. Latitia's cell phone either did not leave the residence that morning or it was turned off, as proven by cell phone data. This is considered very strange by investigators because, as also proven by cell phone data, Latitia was normally on her phone almost constantly. Her phone was actually locked and or off between fifty six am and to forty five pm on January twenty seven. A message will be sent to Harley, who is latitia's biological daughter, not owls. So Harley is not related to Gannon or Lena, and this message was sent from Gannon's cell phone at thirty seven am. It read quote, Titia left phone at home. If you need her, text me. After latitia left with Gannon that morning, she traveled to PETC and made a confirmed purchase at twenty two am. Gannon did not enter...

...the store with her and if you remember, pet co employees reported that Latitio was exhibiting some strange behaviors, such as walking to the front of the store and staring out at the parking lot while she was shopping there. Latitia and Gannon's whereabouts are unknown following this purchase that pet co until one and twenty two PM, when Latitia returned to pet co and made at another purchase, and Gannon was once again not seen on pet coast surveillance video. So it can be assumed he once again waited in the car. At six PM. So jumping back about an hour, I'll sent a text to Gannon that read quote, Hey Buddy, at one hundred and twenty six PM. Gannon replied, quote, can I play Zelda at least, to which I'll replied, quote, not today. Based on the way that this message was typed, I believe that it did in fact come from Ghannon. Later evidence will show that latitia likely made searches on Gannon's phone later in the day intended to look like they were made by Gannon. However, like I said, based on how this one was typed, I do believe that Gannon was texting his father at one hundred and forty three PM, a search was made by Gannon's phone that read, quote, can my parent find my cell phone if it's off? And this is a search that investigators do not believe was made by Gannon for two reasons, the first one being there is a period between between the words phone and if. Latitia would often hit the period key instead of the space bar when making Google searches, as proven by her cell phone data. They also believe that the use of the word parent as opposed to parents is strange. Investigators do not believe that Gannon would have used parents in the singular form. It is believed that Latitia made this search from Gannon's phone because she was planning on disposing of the phone but was not sure of whether or not it could be tracked, and it is also believed that she was kind of thinking ahead, not to give her any credit, but thinking ahead in terms of trying to make it look like Gannon was typing this to maybe point investigators towards him having runaway, not any foul play being involved. Investigators were able to determine that phones can indeed be tracked while off under certain circumstances. It's believed that Latitia came to the same conclusion and thus decided not to dispose of Gannon cell phone. The Nissan Fronts here that the two had taken to Pecco and who knows where else, returns to the residence at twenty two PM. Investigators would later search the vehicle using luminal and no traces of blood evidence were found, indicating that no physical harm came to Gannon while he was out with Latitia that day. The stouth residents had att security equipment inside, which has helped investigators determine some movements that were made inside the home during the day of the murder. Twenty five minutes after the two arrives back at the residence, the eight t system alerts to activity both upstairs and downstairs, and we believe at...

...this time that latitia might have been traveling throughout the house cleaning up the murder scene. Lena, who again is Gannon's biological sister, returned home from school at Three fifteen pm. She would later state that Latitia told her again and was asleep in his bed and that Lena could not see him. I'm pretty sure that this might not have raised alarm bells for Lena at the time, because let's remember that Latitia had been stating that Gannon was sick, so maybe she thought he was just trying to sleep it off, and hopefully she wasn't too worried about her brother at the time. I would hate to think that she was sitting in emotional agony or something before she needed to be. At three fifty five PM, Al would send yet another message to Gannon that read, quote, Hey Buddy. This message was not read until forty that evening, and it is believed that Gannon had already been murdered by this time. Latitia was likely the one that opened and read the message. Harley, who again was LETITIA's seventeen year old daughter, returned to the residence at forty two PM and picked up Lena. It's not stated in the affidavid where the two went, and I haven't seen that reported anywhere else, so I'm not sure where she took her. At fifty two PM, ten minutes after Harley had arrived and then immediately left, latitia sent her a text message asking her to pick up cleaning supplies. These supplies included carpet cleaner, trash bags and baking soda, all of which were more than likely used to clean up the murder scene, and the text that Latitia sent to Harley read, quote, carpet powdered two things, baking soda and trash bags. While Harley has refused to speak with investigators so far, it has been confirmed that she was at work during the time of Gannon's murder and therefore had no direct involvement in that aspect of the crime. Investigators have determined that no one but latitia and briefly Lena when she arrived home, were in the presence of Gannon between ten am and thirty four P M on the twenty seven. Now we're going to move on to some body cam footage evidence collected by investigators. Footage collected from the body Cam of one of the detectives that came to the stock residents after Gannon was reported missing shows that latitia's Volkswagen Tiguan was backed into the garage at the time investigators arrived. This is significant because it is believed that the vehicle was parked this way to disguise blood evidence that was both on the rear end of the vehicle and on the garage floor of the home. Investigators also searched Gannon's bedroom, which was located in the basement and determined, based on the photograph that Latitia had taken of Gannon Asleep earlier that morning, that the bedroom had been slightly rearranged in an attempt to hide blood evidence and based on the amount of blood found. Clearly, blood evidence would have still been visible at the time. Investigators to this day have been unable to locate the betting that Gannon had...

...at the time of his murder. Latitia had already changed the sheets when investigators arrived and collected everything, and I know that would help in the case, but honestly, I would never want to see those sheets. I if there was that much blood left over in the room, I can't even imagine what that looked like. In addition, Al would confirm that the positioning of Gannon's bed following the murder was unusual. The affidavid then goes on to discuss what happened after Al Stouck returns home. So, first of all, Al has been confirmed to have traveled from Denver to Dallas, to Oklahoma and then eventually back to Denver between January twenty five and the morning of January twenty eight. He is not believes to have been involved in this crime in the slightest. Latitia would drive her Volkswagen t Kuan to the airport short term parking lot and she would then rent a key a ryo from the abis rent a car before picking up Al from the airport at fifty am on January twenty eight. It is believed that Gannon's body was still in the trunk of the Volkswagen at this time and therefore latitia did not want to use this vehicle to pick up al. She told Al, however, that the reason she purchased rental vehicle was that she would not want to put too many miles on the Volkswagen as it was a lease. It's I don't want to sound like this is a compliment, but it's pretty bollsy of her to leave the car that investigators believe had Gannon's body in an airport parking lot where. I mean, I know people in airport parking lots don't just look into other people's vehicles, but that easily could have been found. That's crazy to me. I can't believe she did that. Latisha would pick up her Volkswagen from the airport short term parking lot at seven pm on January twenty eight, Latisha actually lied to Al about where she parked the Volkswagen, claiming it was parked near a local elementary school which was called French elementary school. Latisha returned the Kiaio the morning of January twenty nine and was picked up by someone driving a White Jetta, believes to be Harley, as this is the kind of vehicle that she drives. And then also makes me wonder. I'm still assuming that Gannon is in the back of this Volkswagen at this time. So when she returned the Kiaio, did she just leave al at home with her Volkswagen? Maybe he wouldn't have had any reason to go into her car, but I feel like he easily could have discovered Gannon. So she's just I don't even call her ballsy, she's just dumb. She's cleaning. She's clearly not very smart. In terms of the Kiaio that Latisha rented, investigators were granted a search warrant and, interestingly enough, of blood was found. However, when it was tested, it did not match scannon or anyone else relating to this case. Investigators contribute this to...

...the fact that rental cars are utilized by many different people, and they have no way of knowing who the blood belongs to. They just know that it is not related to Gannon's death. In particular, GPS information was not able to be obtained for the key or Rio during the time that latitia had it. However, it is assumed that it was not used in the disposal of Gannon. Now we're going to move on to evidence found in the Volkswagen to Juan so GPS information for this car was also not able to be obtained by investigators. They were interested, however, in the vehicle's location between the hours of two PM on January twenty eight and noon of January twenty nine. It is believed that the Volkswagen was used to dispose of Gannon's body in its initial location. During this time, latitia arrived to an interview with police at noon on January twenty nine, despite her interview being scheduled for ten am. So she's not only dumb, she's clearly very time conscious as well. And upon her arrival, investigators noted that the vehicle appeared to be wet and freshly washed, and this would be confirmed from surveillance video taken from a local car wash. While at Tiho was being interviewed, investigators were able to obtain a search warrant for the Volkswagen Bl blood evidence was found on the rear of the vehicle, in the rear passenger seat, in the front passenger seat, on the glove box and on the vehicle's rear bumper. A receipt was also located that showed the purchase of trash bags, vinegar and baking soda from a dollar store on January twenty seven at fourteen pm, and these are the items that are believes to have been purchased by Harley. Now we're going to move a little more into the meat of what was said during Latitia's interview. Upon meeting with investigators, latitia almost immediately drastically changed her story, and she also, interestingly, brought several pages of notes to her interview and requested to simply read from them, something investigators said they had never seen before and have since stated very, very rarely happens. Investigators and fortunately, were not able to take these notes from latitia before the interview concluded and have never come to possess them. Latitia told investigators that she had met a residential construction worker named Iguardo on January twenty six, following the incidents where Gannon allegedly knocked over a candle and burn some of the carpet in their home, she stated that she was driving around and came across some workers, upon which she arranged for Aguardo to come and repair their carpet while Latitia and Gannon were out shopping the next day. She then stated that at when her and Gannon arrived home around thirty on the twenty seven, Eduardo was there and he proceeded to hold latitia at gunpoint and sexually assault her. She states that she believes she hit her head during this assaults...

...and blacked out. She also states that, while she was being attacked, Gannon jumped on Aguardo's back and an attempt to help her, and Eduardo threw him across the room and then demanded a suitcase, which latitia quickly gave to him, along with a cardboard box. A guardo then again began to sexually assault Latitia, and she once again claims to have hit her head and blacked out a second time. She concluded her statement by stating that IGUARDO had abducted Gannon. Investigators noted that latitia showed no signs of a head injury and she refused as sexual assault nurse exam or a stay an exam. And I think it's interesting that latitia claims to have blocked out twice during's attack. However, she was still able to give details, like Gannon supposedly jumping on the Guardo and what a Guardo asked for before leaving the House and abducting Gannon. She is not good at keeping her story straight, not in the slightest. Latitia then stated that she cleaned up the area where the assault had taken place and took no action in regards to reporting either the assault or the abduction of Gannon and, as we know, when she finally called the police, she gave a completely different story about him going to play a friend's house. She was also unable to provide a physical description of Aguardo, apart from a Hispanic mail with dark eyes. She reported that this alleged attack occurred between three thirty and thirty PM, during which time investigators were able to determine that there was activity on Latitia's cell phone and, through the a d t system, that someone was moving throughout the house, neither of which likely would have happened had the attack gone the way letitia stated it did, because I'm sure Aguardo wouldn't have let anyone move throughout the house and he definitely wouldn't have let latitia be on her cell phone throughout the interview. Latitia would deny bringing any harm to Gannon. Once latitia stated that she wanted to leave, investigators seized her cell phone and attempted to get a DNA sample from her. Upon the request for DNA, latitia began complaining of chest pains and shortness of breath. Investigators called paramedics who transported Latitia to the hospital and once at the hospital, Letitia Somehow, I'm made a miraculous recovery and after this happened, the hospital told her that they would be taking her DNA to give to investigators. So she made swift moves to call an unknown friend and be picked up. So her DNA still hasn't been taken at this point because she's managed to get out of it every single time. We're going to move on now to more cell phone evidence collected from Latitia's phone. So we've already stated that latitia often used the period instead of the space key when conducting google searches and this appeal years often in several really weird google searches that were found on latitious phone, of which I will read to you now. So she searched, quote, find me a new...

...husband, book. Quote. I feel like I'm just a nanny, not a stepmom. Quote. Husband uses me to babysit his kids. Quotes. Are there any free money to move away from bad situation? Quote? My husband never post about me, but does everything else. Quote. My husband only cleans up for the army, not me. Quotes. I'm just a glorified babysitter. Quote, find a new husband. Quote. Sent my husband's sexual messages and he ignores them. Quote. Make husband want me? More quotes. I feel like my husband uses me to babysit his kids. And finally, quote, find a guy without kids. And these Google searches to me, just point to how weird her head spaces, because some of these aren't even questions. Like I'm just a glorified babysitter. What Google results are you expecting? That doesn't even make any sense. And I feel like I'm just a nanny, not a stepmom. Again, what Google results are you expecting from that? It seems like she just types her thoughts into Google. Sometimes I truly I do not understand this woman's mindset. And going back to the Nintendo switch that we discussed earlier, she also was found to have googled can Nintendo find my switch? Investigators would google the same thing and discover that Nintendo switches do not come with any sort of tracking device and to this day Gannon switch that was so precious to him has not been found. So it's believed that Latitia felt comfortable enough to get rid of that. On January twenty eight, at Nineteen PM, latitia would search quote they are asking for our son's toothbrush, but said nothing is wrong. She then had the following text conversation with Al Latitia. Something isn't right. I think they are hiding something. AL, who the police? Latitia. Yes, they asked for toothbrushes. AL, HMM, what do you think they're hiding? At forty five that same evening. So the night of January twenty eight, Latitia sent the following text message to an investigator. What do you want from me, because I have nothing. One of your very own leaks to me what you guys were doing. I did nothing and or am being set up I'm not really even sure, other that being told that by another blue with L Passo. I was told I couldn't go home to sleep and on top of that, men were sent to a home with a minor female and she was forced to stay there, not even to leave for food. Every conversation. That said, even at this moment, I can hear inside. What do you want from me? So again, that doesn't make much sense. She's clearly not a very literate text. Soon after sending that, the detective would reply, come in and talk to me. I would just like information to find Gannon.

Now we're going to move on to some different stories that latitia provided to al about what had happened to Gannon. I truly cannot stress enough how much this woman cannot keep her story straight. She gave one story to the nine one caller. When she reported again and missing, she almost immediately gave a totally different story to the investigators and she would give Al four different stories, which I'm so sad to read that she kept changing her story with him, especially because I'm sure that the more she changed it, the more he knew that she had done something to her son. So my heart still goes out to this man and all of Gannon's family members. This whole affidavit is so, so heartbreaking. But the first story that Latitia gave to Al was that when the police first came to their residence on January twenty seven, the abductor was actually still there and that she tried to signal deputies that there was somebody in the house. However, they either didn't understand what she was trying to do or didn't believe her. It should be noted that deputies checked the entirety of the House and did not find any signs of any addition, no person or any attack or anything of the sort. Story number two is she was raped by a man named Quincy Brown, who all discuss a little bit later at the residence, and that Brown abducted Gannon. She knew Quincy Brown's name because a quote identification card had fallen out of his pocket that had his name on it. Obviously, latitia would send a photograph of Quincy Brown to Al via text message, and again I'll discuss in a minute how she would have had a photograph of this man. So story number three kind of elaborates on the last one. She states that Quincy Brown followed her and Gannon home from PETCO and at some point he was just lying in the middle of the road in front of their car. Latitia then stopped to avoid running him over and at this point he jumped into the car and made her take him home, where he sexually assaulted her. And story number four is that Latitia and Gannon were near county line road, highway one hundred and five, which, if you'll remember, is where a DNA belonging to Gannon was found and it's where it is believed that latitia initially dumped his body. But anyway, that Latitia and Gannon were near that highway and that Gannon was riding a bike and fell off and hit his head and then Quincy Brown came out of nowhere and abducted him. Yeah, once again, cannot keep her story straight to save her life, which I mean in retrospect, is a good thing. The more she screws up her story, the more guilty she looks and the more investigators have on her. But I truly just can't believe that this woman is either that oblivious or that dumb, or both. I mean, she continues to...

...amaze me throughout the entirety of this affidavit. He amazes me in the worst possible way. Anyway, now on to how she was able to obtain information on Quincy Brown. Quincy Brown was a thirty seven year old man who had been listed on El Paso County's most wanted list in early February of two thousand and twenty. He was believed to be a widely known criminal in the area, so it is very possible that latitia had seen new stories about him and knew that he wasn't in jail yet, so she thought he would be a believable person to throw the blame on, someone that had committed heinous crimes before and someone that would take the spotlight off of her. We're going to move on now to something else insane that latitia did to try and convince every one of her innocence. She visited a site called fake polygraphcom, in which she attempted to obtain of fake polygraph, to be more specific, a copy of a past polygraph exam that she could show both to the media and to investigators. I'm not sure how she intended to trick investigators into thinking that she had both taken and passed a polygraph, but I will not even begin to pretend to understand this woman. The website, however, flagged the questions that Letitia had entered and refused to send her the fake polygraph exam stating that, quote, with any illegal activities, they reserved the right to not send the report. And what kind of questions do you have to enter to get a website that is literally designed to help people get out of legal situations? I'm assuming to not send you the polygraph that you're requesting. I mean, that's insane, but this woman is evil and actually, to answer my question, we know what kind of questions she was asking. They are included in the affidavit and I will read them to you now. The first one was do you intend to answer these questions regarding your step son truthfully? Second one, is your birthday August? Fourth, one thousand nine hundred and eighty three. Third One, did you participate in any way in causing harm to your stepson? Fourth one, did your step son return with you to your home? Fifth one, did you participate in any way and causing the death of your step son? So yeah, pretty suspicious questions. I absolutely applaud fake polygraphcom for not sending her this report and actually just some a little bit of a silver lining on this, because latitious sucks. She actually paid for the polygraph prior to entering those questions and they kept her money even though they didn't send it to her. So I also appreciate fake polygraphcom for that. She did not deserve that money back. So that covers it for the most part. I mean again, I picked out all the information. I spent hours with this affidavid and I took out everything that I believe helps us have a better understanding...

...of the case and of what happened. Since Gannon's body had not yet been found at the time that this affidavit was written, there is not much, if anything, that details when and or how the Teasha made it to Florida, where we know that Gannon's body was eventually dumped and then found. I would assume that she had help. I mean she had help in other areas of this case. We know that someone picked her up from the hospital, despite, I assume, knowing that she was in at least a little bit of legal trouble at the time. We know that her daughter picked up cleaning supplies and is now refusing to talk to the police. So I can definitely understand not wanting to incriminate your mom, but I just have to assume that Harley knows something, otherwise I believe she would talk to the police. I mean, she's not even attempting to say that she didn't know what the cleaning supplies were for. She just not talking. I don't want to assume Harley's guilt and I'm definitely not doing that, but I also don't think it's unreasonable to assume that Harley may have played a bigger part in the aftermath of the crime then we know at the moment. So, in conclusion, the affidavit at the very end states that, quote, in over seventy one percent of homicide cases that involve false reporting, the reporting party is responsible for the murder and, quote, latitia continuously provided false stories that continued to change and evolve and largely made absolutely no sense. This, along with the copious amounts of physical evidence, cell phone data and video surveillance collected by detectives, seems to have proved to them that latitias stout was in fact the responsible party in young Gannon Stout's murder. And I just want to end with some thoughts I have. Again, I can't stress how sad this case makes me. I mean, this is just a little boy that did nothing, nothing at all, to deserve this. And it's clear that latitia wanted to leave the relationship, that she wasn't happy, that she felt more like a babysitter than a wife. But then just leave him? What reason could she have possibly had? I mean, there is no reason, but I'm sure in her crazy mind there is one. What could have possibly gone through her mind when she decided to do this to Gannon? What could have possibly gone through her mind when she decided to change her story so many times? This truly is a wild case, an insane woman, and and I am so glad that it looks like she is about to be brought to justice. I again want Gannon's family and anyone that knew him, knew the family that might listen to this, to know that my heart goes out to you all. I so hope to...

...see justice for Gannon in this case and again, I'm so sure that we will. With that being said, thank you everyone for listening.
